Botting on instagram/facebook, risks and potential consequences, have your say

Hello,

So I have been thinking about people botting (harcore and breaking sites' TOS);
Lets say, a person decides to start using this methods in order to do CPA via FB. This person uses a secure VPS and private proxies for the accounts spamming.
Can this person be traced down by authorities? I was having an argument and I think they could simply see a ton of bots spamming with the same affiliate link, go to the network and ask for the details of the person's account. My friend, on the contrary, argues that they cannot ask the details from the network based on the privacy policy thus network could have.

What do you guys think? Can authorities track a person down? if so, how? Are vps and proxies a secure way to get covered? Would a privacy policy protect you from the law?
